As of July 1, 2018, ADUs are allowed by right on all residential properties within most Oregon cities and counties. The right to build an ADU is still subject to local regulations and codes regarding the size and location of the accessory structure.
The most common ADU codes administered by Oregon cities and counties regulate the:
size of the ADU;
location of the ADU; and
design guidelines or architectural consistency with the primary residence.
In addition, each jurisdiction has its own process for permitting ADUs and can assess its own fees for permits and development impact. In particular, impact fees or system development charges (SDCs) vary widely among local communities, with some communities waiving these fees entirely and others charging fees of $20,000 or more per ADU.
